    WASHINGTON, May 18 � Six months after Republicans lost control of Congress, President Bush is learning the rules of a game that, for six years, he seemed to have forgotten: the Capitol Hill edition of �Let�s Make a Deal.�

    In the last eight days alone, talks involving cabinet secretaries and other high-ranking White House officials have produced two surprises: a major compromise with Democrats on trade and Thursday�s fragile bipartisan accord on immigration. The question now is whether the sudden burst of deal-making will extend from these easier targets to the most intractable issue in Washington: the war in Iraq.

    It is still far from clear whether the Bush administration and Congressional Democrats can be flexible enough to reach an accommodation on war spending � and indeed, the Iraq talks stumbled on Friday. What is clear is that both Mr. Bush and his rivals are shying from the path of confrontation. Democrats, for the most part, are refraining from muscle-flexing, showers of subpoenas and other displays of new clout. And a White House hungry for legislative victories is working hard to negotiate a vastly changed political landscape.

    �The president has become belatedly pragmatic,� said Ross Baker, an expert in presidential-Congressional relations at Rutgers University. �I think it took a while for him to recognize that the ground rules have changed, but he seems finally to have come around to the realization that he�s not working with a docile Congress of his own party, but with people who really have decided that they are going to challenge him.�

    The White House chief of staff, Joshua B. Bolten, who is the president�s lead negotiator on the Iraq bill, conceded in an interview earlier this week that it had been difficult for the administration to get accustomed to not controlling the legislative agenda.

    Yet despite �a fair amount of substantive tension� in the relationship with Democrats, Mr. Bolten said, the immigration and trade deals have left him feeling encouraged.

    �We have some ways to go,� he said, �but there is a process of confidence building that accumulates over time.�

    Maybe so, but after six years of being virtually ignored by the administration, many Democrats remain wary. Senator Byron L. Dorgan, Democrat of North Dakota, complained on Friday that the Bush White House had �never been very interested in anything except the way they wanted to do business.� Mr. Dorgan said he was not impressed with the fact, given the change of party power, that they are talking.

    �That gives credit for low expectations,� he said.

    Others, less in the thick of things, sounded more upbeat. Leon E. Panetta, a former chief of staff to President Bill Clinton, said he had been concerned, once the Democrats took control of Congress, that �an awful lot of blood in the water� would prevent the parties from coming to terms on �low-hanging fruit� like immigration and trade.

    In Mr. Panetta�s view, the talks are a good sign. �Whether it can go into bigger areas like the war remains to be seen,� he said. �But it clearly helps build at least a rapport that you absolutely need if you�re going to try to come to a deal.�

    Mr. Bush, of course, is not the first president who was forced to come to grips with a new political reality after losing control of Congress. Mr. Clinton did just that after Democrats lost the House of Representatives in 1994. That loss created the political climate that enabled Mr. Clinton to make good on his promise to revamp the nation�s welfare system.

    Likewise, the change in November has made it easier for Mr. Bush to pursue his trade agenda and his long-cherished goal of immigration overhaul.

    In the trade deal, the administration�s unlikely partner was Representative Charles B. Rangel, the tough-talking Democrat from Harlem. The White House acceded to his demands for child labor and environmental protections in several pending trade pacts, a move that would have been unthinkable when Republicans controlled the House, because Mr. Rangel�s Republican predecessor as chairman of the Ways and Means Committee, Bill Thomas of California, would have blocked it.

    On immigration, Mr. Bush�s position already seemed nearer that of Democrats than Republicans, and some in his own party are highly nervous about the deal. Senator Trent Lott of Mississippi, the Republican whip, who was majority leader when Mr. Clinton was president, said Republicans would criticize the administration as giving away too much on immigration, just as Democrats criticized Mr. Clinton as giving away too much on welfare overhaul.

    �But,� Mr. Lott said, �I would argue that the White House is coming to terms with the reality of the situation in Washington, and they don�t have any choice. We can all get into our partisan crouches and get nothing, or we can go through a process of responsible negotiations.�

    Administration officials say both sides seem to be learning as they go. But Iraq is an area where Mr. Bush has been especially unwilling to yield. He has made clear he has little interest in sharing his power as commander in chief.

    While Mr. Bush has been trying to strike a conciliatory tone � he said Thursday that he would accept benchmarks for the Iraqi government � the breakdown in talks on Friday was a reminder that Iraq is not immigration or trade, and the president will only go so far.

    Some say the trade and immigration deals could actually work against compromise on Iraq. After cutting two big deals, Democrats and Republicans might not be inclined toward another one, for fear that they will look wishy-washy with their respective political bases.

    On the other hand, one force pushing toward compromise is that neither side can afford to get blamed for holding back money from the troops. Even so, Mr. Panetta says it is too early to be optimistic.

    �There�s some light at the end of the tunnel,� he said, ��but it could get dark real fast.�

    I filed for EAD (new application) 30 days back along with my AOS applications. Finished my FP on the 25th day.

    Normally How long it take to get EAD from Texas Service center. ??

    Any idea. ??

    Now a days EAD is coming pretty quick. Some one got within a week. So it depends any where between 30 to 90 days.

    We have been applying for advance parole document at NSC for the last few years.

    This time we sent our application to NSC on 01/28/2010.
    After about 15 days, we received a receipt notice letter from Vermont service center.

    The I-131 application instructions specify that I-140 based applications should be sent to either Nebraska or Texas service centers.

    I am wondering if USCIS started processing I-131 application in VSC.
    Or our application is mistakenly misclassified and sent to VSC.

    Any comments?

    I filed my I-485 in Aug�2007 and my I-140 is approved in EB2. My daughter was on dependent H-4 and her I-485 also was filed in Aug�07 as dependent on my GC. She completed 21 year in June�2008.

    My question is if we receive our GC in current year, she will get GC as she already crossed 21 years? Appreciate your answer and thank you in advance.

    Hi there,
    I am currently 29 yrs old. I have had my green card for 9 years now. However, I was arrest when i was in college at the age of 20, was convicted of a misdemeanor account of drug possession. Youth and stupidity some times does go hand in hand. :mad:
    My question is this, should i apply for citizenship next year, GC expiring 2010. Or should I just extend GC. I have stay out of trouble ever since, not even a speeding ticket. I have turned my life around and currently a home owner. :rolleyes:
    Does anyone know any case of a successful naturalization of a drug case that was none marijuana related? Any advice is greatly appreciated... thanks in advance!!;)

    Dear all,

    My husband and I had applied last july for I-485. I am expected to renew my Advance parole document this month i.e August. I have not sent any documents to USCIS as of now. Today I checked the status of my LUDs and I see that there is a change in LUD status of Advance Parole, it now shows 27th july 2008.

    Could anyone tell me why this change when no documents have been even sent? No other of my cases are showing change such as I-485, EAD.

    If the company has 4-5 other accountants then the company should be really large with a separate accounting department or should be an accounting firm. Otherwise the question will arise as to why they need so many accountants working in-house. Should be sufficient if you list all people and provide the educational details, their are also otherways of responding to this RFE and alternative ways of responding to this particual question to show that it is common in the industry to hire people with a bachelors....etc, i would take the help of an attorney if i was in your place.

    The question is:
    Can i file GC under PERM for the new role ( same company) in California. Assuming the PERM LC gets approved, can i port the PD of Oct 2004?

    Congratulations to Swedish-born Paul N.J. Ottosson who won two Academy Awards this evening for Best Sound Editing and Best Sound Mixing for The Hurt Locker. Ottosson came on a tourist visa in the 80s with some friends to try and make it as a rock musician. His friends went home, but he stayedand went on to become one of the top people in one of the most important jobs in filmmaking. There is the pro-immigration camp which generally favors immigration reform proposals introduced over the last few years. Within the pro-immigration camp, there is the labor left which is in favor of legalization but balks at provisions that would provide temporary or permanent visas to workers that might come in the future.     I am about to file my I-485, EAD and AP in July. My company (ABC) acquired by investment company (XYZ) 2 months back and changed from public company to private company. My company (ABC) is still exists as an same entity and an independent company but name changed from ABC corporation to ABC LLC, my job description is same and still my pay stubs are from ABC corporation and Tax-id is also same. Do I need to file for I-140 and H1B amendments? If yes, when should I do it? While filing I-485 or after filing I-485 or before filing I-485? What is the impact on I-485 if amendment is not filed?

    if it is an extension of B2 status, I don't think your case will be transferred to a different center if you move to a different state. you just have to inform the service center regarding change of address(I think you can send a AR-11 form) this is just my personal opinion. please check with the lawyer who filed your extension or other experts

    President Bush�s nominee for attorney general, Michael Mukasey, was asked an important question about Congress�s power at his confirmation hearing. If witnesses claim executive privilege and refuse to respond to Congressional subpoenas in the United States attorneys scandal � as Karl Rove and Harriet Miers have done � and Congress holds them in contempt, would his Justice Department refer the matter to a grand jury for criminal prosecution, as federal law requires?

    Mr. Mukasey suggested the answer would be no. That was hardly his only slap-down of Congress. He made the startling claim that a president can defy laws if he or she is acting within the authority �to defend the country.� That is a mighty large exception to the rule that Congress�s laws are supreme.

    The founders wanted the �people�s branch� to be strong, but the Bush administration has usurped a frightening number of Congress�s powers � with very little resistance. The question is whether members of Congress of both parties will do anything about it.

    Congress is often described as one of three coequal branches, but that is not entirely true. As Akhil Reed Amar, a Yale law professor, observed in �America�s Constitution: a Biography,� Article I actually makes Congress �first among equals, with wide power to structure the second-mentioned executive and third-mentioned judicial branches.�

    Article I, which describes Congress�s powers, is the Constitution�s first, longest and most generously worded article. It gives Congress a wide array of specific powers, but also broad authority to pass laws that bring to life �all other powers vested by this Constitution in the government of the United States, or in any department or officer thereof.�

    It would be hard to recognize that powerful Congress today. In part, that is because Congress has been unwilling or unable to enact laws on the most important issues facing the nation � Iraq, immigration reform, health care.

    Just as troubling, though, is how it has allowed its institutional power to erode. President Bush has regularly issued signing statements � including on critical issues like the ban on torture � that assert his right to ignore new laws at the same time as he signs them. These signing statements are not just talk. A report by the nonpartisan Government Accountability Office states that in nearly one-third of the cases it looked at, after President Bush issued a signing statement objecting to a provision of a new law, his administration did not implement it as written.

    The Senate has routinely confirmed judicial nominees who make no secret of their belief that the president�s power should be sweeping, and Congress�s sharply cut back.

    The Senate confirmed Jeffrey Sutton to a federal appeals court judgeship even though Patrick Leahy, now the Senate Judiciary Committee chairman, observed that as a lawyer Mr. Sutton �aggressively sought out cases to limit the power of Congress to enact laws protecting individual rights.� It confirmed Janice Rogers Brown to the powerful United States Court of Appeals for the District of Columbia Circuit even though she had suggested that much of the legislation passed during the New Deal � including the Social Security Act � was unconstitutional.

    There are things Congress can do. It can start by speaking out about the importance of Congressional power the way the administration has talked about deferring to the commander in chief. Congress should pass laws that support its own power � like a bipartisan one that Senator Arlen Specter, Republican of Pennsylvania, has introduced to nullify the impact of signing statements.

    The Senate should refuse to confirm nominees who do not take Congressional power seriously. And Congress should make clear that if the executive branch will not enforce its subpoenas, it will use its own �inherent contempt� powers to do so.

    Right now, standing up for Congress may appeal more to Democrats than Republicans. The issue of reining in presidential power is beginning to gain traction among conservatives, however, as they contemplate the possibility of a Democrat � particularly Hillary Clinton � as president.

    Defending Congressional authority should not be a partisan issue. The founders wanted a strong Congress because they understood the importance of ensuring that the most democratic branch have a strong say in how the nation is run.

    Need help

    I have approved labor for PD 2004 and I-140 got rejected in Dec'2006 due to education credential with 3 year degree. currently my I-290 is pending with AAO appeal for more than 10 months and my extension is based on that.

    New labor is filed in June'2007 and got approved in September. I-140 is pending for the new labor.

    My Current extension is getting expired in January 2008. If I get premium processed my extension on old case and if my appeal gets denied will my extension or my status gets invalid or I have valid extension upto next January to get other I-140 approval ?

    Please let me know ASAP so I can request premium process for extension.

    I have got an offer from 2 companies for H1 . One is from INFOREEM (NJ based) and other is AFFUEL SYSTEMS (TAMPA/Atlanta based). Can anybody please has any reviews?

    I sent my EAD application on 10/24(Wednesday), reached NSC on 10/26(Friday), Notice date 10/29(Monday), Check cashed 10/30(Tuesday)..Already got I-485 receipts back in August.

    So they are Current now.... But what about those July/Aug filers who are still waiting for their receipts? Very unfair to them. I could wait for 2 months to get my EAD receipt if they could first receipt all july august filers...

    They are really unpredictable..

    (1) I have applied my Labor Certification in February 2003 and It is approved in September 20, 2007. After almost 4 years. Now, my employer is ready to file I-140 by October 10, 2007. I am also in my 7th year of H1-B visa and it is expiring in August 24, 2008. I have heard that you need to have 365 days of time period between Labor Approval and H1-B renewal of VISA for 8th year. If my I-140 is still in pending stage until August 2008, still Will I be able to get my H1-B extension for 8th year? In reality, I am short of 60 days to finish the count of 365 days.

    (2) On the other side, I may not have worry as my Labor was filed in year 2003.

    Any Clarifications?

    They might increase the no. of H1Bs but might not do any refinement in the immigration process I guess.:o
    So can't say how that would be advantageous but nevertheless the economy is boomin and there are lots of jobz.:)

    I am married with an American Citizen. His petition has been approved. My problem is that I cant change my status because my J1 visa was subject to the 2 years home country. I came as an Au Pair or Child Care Provider in 2007. I have been subject to that rule because the Skill List from 1997, which is not even in any field in my country El Salvador in the Skill List. That is why my application is hereby denied.

    I dont know what i should do, because just I have 15 days to make a motions to reopen o pay a waiver and re-file my application all over again.

    Please I need help is anyone can advice me in this. I really need it.

    Please help me. I am in a really odd situation.

    My I797 expires on Feb 10th (in 2 days!). My company did not know of the iCert change. iCert denied the first 2 LCA attempts for FEIN and prevailing wage issues. The new LCA (3rd attempt) won't have a result until the 15th.

    My i-94 and visa has expiration of in Oct 2011 (stamping officer's mistake). But I know, we can't rely on their mistakes.

    What can I do? Please advice..

    meaning that I can seek employment with a university anytime and get a H1B relatively easy?

    I applied for the I-140 and I-485 at the same time last October 9th 2009. I was requested an RFE in February of 2010 which they received back in March before the deadline. The RFE was looking for some basic info. I am still awaiting a response to the RFE or approval of the I-140. My job is currently going through tough times and there are rumors I will be laid of on April 30th. My question is that after April 9th(180 days after i filled I-140 and I-485) can i move jobs to a similar role before my I-140 is approved and if so what do i need to do.

    HI,
    My company is processing my Green card and recently applied my I-140. My wife is applying for residency this year. Most of hospitals are saying that they can sponsor only a J-1 visa. Can you please suggest if this would be a problem for my Green Card processing and/or her visa stamping (Since applying for G.C means that we wants to stay and J-1 means the other way round)?

    After we have filed for 485 and lets say we (me and my spouse) receive our EAD's. If I quit my job after 6 months of filing, can my spouse (secondary applicant) continue to renew her EAD's or would she have problems since I (the primary applicant) is no longer working for the company and maybe working for myself?
