My son came to USA on H4 Visa. He completed his studies on F1 Visa and worked for some time on H1B Visa.

Then he went to Canada for higher studies. He holds Canada PR.

I am in US. If I apply for his I 130, would there be probem him visiting US on B2 Visa.

Hi,

I switched from H1 to EAD with the same employer. Due to family emergency i got to leave and may have to stay for more than 2+ months.

Would that be ok if i stay out of country while on EAD. I will be returning back using my AP.

It depends upon your luck with AP. Because you never know when they will be approving your AP and in case it is lost in Mail (it happens to lot of people) and you need to re-apply with fees again. This is very tricky....... You may get it in few weeks or few months or never. Not to discourage you, it really how lucky you are. All the best. I always will file 3-4 months in advance.

Hi,
Currently I am on H1B visa.I will file my 485 as secondary applicant.What are my options in case If I have to leave my job and my 485 is still not approved.

Do I need to file H4 (Since 485 is still not approved) ?

You can status will be Adjustment of Status ( AOS ) but cant work . IYou need a APO if you want to travel . If you want to work you need an EAD .

Check with attorney .This is the essence of mail which i got from my attorney when asked regarding my son status

Folks,

I just realized that I forgot to add a piece of my employment history to the DS-160. I only realized it once I set up the appointment for H1-B stamping through VFS. I have all the corroborating paperwork (W2, paystub etc.) for that period. Do I need to re-do the DS-160? I already have an appointment and if I cancel the appointment and re-do the DS160 I might run the risk of not getting the date of my choosing. The problem is my existing company is a "successor in interest" of the company I forgot to mention. That is, I got my I-797 from this previous company.

Please not that the facts in the existing DS 160 are true. It is just that I realized that there is a gap that I might have to fill.

Scenario:

Working on H1. Wife is on H4. Waiting for our EADs.
Planning to work for H1-GC sponsorer employer until (or I should say 6 months after) we get the GC.

I am running a website and am planning to sell the advertising space?

Q1: Can a H1 legally receive the money from website advertising on his/her website?

Q2: Can a H1 register DBA?

Q3: How about if H1 uses EAD, can then he register DBA and legally receive the money from website advertising? (I know once you use EAD your H1 becomes invalid).

Q4: I know I can register DBA in wife's name when she receive EAD? Is that the only option I have?

Please share your thoughts!

Its okay to file the 485 at either texas or nebraska. Normally the lawyers file 485 to the same center where your 140 got approved. from.

Hi ,
1.My wife works for part ime H1b. She has her H1B till Aug 2011. She would Like to apply for her GC. Can she apply for labor certification with part time job? She can get a full time job after she gets in to adjustment of status. She doesn't want full time job now as our kids are still small.

2.I have a fulltime H1B and Approved I-140 EB2. PD sept 2007, waiting for retrogression to file 485!!!! god know when that will happen.Can I apply for EB1 while my EB2 pending?
I have good credential to meet EB1.
